That letter stated that Malott wanted to discuss the issue during an upcoming board meeting if Schatzman was unwilling to reconsider./p p class="MsoNormal"o:p /o:p/p p class="MsoNormal"“… sunlight is the best disinfectant,” Malott’s letter stated. “… when in doubt, I expect our staff to put its collective thumb on the scale in favor of disclosure, rather than nondisclosure.”/p p class="MsoNormal"o:p /o:p/p p class="MsoNormal"Late last month, the ERB and a href="http://www.sic.state.nm.us/" target="_blank"State Investment Council/a (SIC) both a href="http://haussamen.blogspot.com/2009/05/state-agencies-deny-requests-for.html"denied requests/a from me and others for copies of subpoenas from the U.S. Attorney’s Office related to investments. In denying my request, Schatzman cited the exemption to the state’s a href="http://www.nmag.gov/pdf/AGO%20IPRA%20Guide.pdf" target="_blank"Inspection of Public Records Act/a that allows for denial “as otherwise provided by law,” and wrote in a href="http://www.haussamen.com/ERB-Denial.pdf" target="_blank"his letter/a that the federal public records law in some instances exempts records compiled for law enforcement purposes./p p class="MsoNormal"o:p /o:p/p p class="MsoNormal"While New Mexico courts have not addressed whether that federal exemption applies to state law, some other states’ courts have said it does apply there, according to Schatzman’s letter. a href="http://www.haussamen.com/SIC-Denial.pdf" target="_blank"The SIC’s letter/a, from Public Information Officer Charles Wollmann, says essentially the same thing./p p class="MsoNormal"o:p /o:p/p p class="MsoNormal"The responses from the ERB and SIC are different from those I received recently from two other state agencies that have been subpoenaed in federal investigations. The governor’s office has a href="http://haussamen.blogspot.com/2009/02/guvs-office-releases-subpoena-nmfa-does.html"released the subpoena/a it has received in the federal probe of allegations of pay to play in the Richardson administration./p p class="MsoNormal"o:p /o:p/p p class="MsoNormal"Meanwhile, the a href="http://www.nmfa.net/" target="_blank"New Mexico Finance Authority/a (NMFA) has a href="http://haussamen.blogspot.com/2009/02/state-agency-wont-release-gripgate.html"denied my request/a for the subpoena it received in the pay to play probe. My business, Haussamen Publications, which publishes this site, has a href="http://haussamen.blogspot.com/2009/04/lawsuit-seeks-release-of-gripgate.html"sued the NMFA/a to try to force the release of that subpoena. The lawsuit is pending./p p class="MsoNormal"o:p /o:p/p p class="MsoNormal"In his letter, Malott referenced the release of the subpoena by the governor’s office in urging Schatzman to reconsider. But he also wrote that he doesn’t know whether law enforcement has requested that the ERB not release the subpoenas.
