Kenyan MPs have voted against creating a special tribunal to try those involved in the 2008 post-election violence. The BBC reports that this could mean that the cases get referred to the International Criminal Court - which does have the power to step in if the relevant country does not have its own judicial mechanisms for dealing with the cases in question. The ICC may have great difficulty arresting the suspects and holding the trial - however it does show that the international community is trying to enforce standards of human rights and hold to account those who have violated them. The Kenyan public do seem to be suspicious of their own judicial system and, perhaps, many of them would prefer the issue to be dealt with by outsiders [who might be seen as more impartial] than a domestic court.
